ラトヴィアはロシアとの2国間条約の規定の適用を一方的に停止できるか?

ラトヴィア国内には旧ソ連兵士の墓所と記念碑があり、ラトヴィアは1994年にロシアと締結した退役ロシア軍人の社会保障に関する協定13条でこれを維持し保全する義務を負っている。
Art. 13 With reference to international practice, the Latvian Party shall ensure maintenance and preservation of memorials and places of mass burial of warriors on the territory of the Republic of Latvia, as well as shall not put obstacles to the burial of deceased military pensioners and their family members and to the carrying out of the burial rites.
Equally, the Russian Party shall ensure maintenance and preservation of memorials and places of burial of Latvians, Livonians and citizens of Latvia who perished during wars and repressions on the territory of the Russian Federation.
5月12日、ラトヴィア議会は、協定13条を運用停止し、首都リガにある記念碑を撤去することを認める法律を可決した(RFERL)。
5月20日には戦勝記念日の撤去を求めるデモが行われている(AFP)。
5月13日、Telegram上で、協定の有効期間中に一方的行動をとらないことを定めた協定15条違反であり、またVCLT 42条の定める終了等の事由も満たさないとして非難した。
This traitorous, unjustified step has neither moral nor legal grounds and constitutes a flagrant violation of the universally recognized principles and norms of international law, including the provisions of this very treaty.

Article 15 of the Agreement obliges the Parties to refrain from taking any uncoordinated unilateral actions on issues regulated by this document. The same Article clearly states that the Agreement will remain in effect until amended or terminated with the consent of the Parties.
It is worth noting that no one has held any consultations with us on this issue, not a hint of it.
Another reliable document is the Vienna Convention on the Law of Treaties of 1969. Article 42 states: the termination of an international treaty, its denunciation or withdrawal of a party may take place only in conformity with the provisions of the treaty or the Vienna Convention.
This situation clearly demonstrates for the entire responsible international community the true face of the political elite of modern Latvia: cynicism, double standards, a complete rejection of civilized ways of settling interstate issues and brazen disregard for the fundamental principles of international law.
Art. 15 This Agreement is subject to ratification. It shall be temporarily applied as of the date of its signature and shall take effect as of the date of exchange with the ratification instruments. The Parties shall submit the Agreement for ratification without delay, for it to take effect no later than June 30, 1994. The Agreement shall be effective as long as it is changed or terminated upon mutual agreement of the Parties.
During the effective term of the Agreement the Parties undertake to refrain from uncoordinated unilateral moves with regard to issues regulated by this Agreement.
